We live in Temecula, Ca (in rural wine country) and our neighbor threatened to shoot our dog if she goes on his property. Is that legal in So Cal? It’s not just our dogs there are about 2 other neighbor hood dogs (pitbull & mixed dog) that play with our 3 dogs( small lab, shih tzu, and chow mix) in the morning and they all go back into the fields and chase rabbits, but he just has a problem with our dogs. They are all really friendly and this guy has a stick up his butt because none of them like him (good judges’ of character). This guy has serious mental issues’ and is completely delusional. We have several police reports on him for harassment and elderly abuse towards my Grandpa. But he just now threatened us with harming the dogs. Is shooting someone’s dogs legal??

We live on 2.5 acres, and every property around us has open land….He has built a fence, but not enclosing his entire property just a straight fence with barbed wire on it…

The law states that dogs must be on a leash if not being personally supervised by someone, so to avoid conflict, the easy thing to do is put pooches on leashes :]

No - he can’t shoot your dog for Trespassing !
Yes - if he has Livestock of any kind on his property then he can claim that your dog was harassing his animals and can legally shot your dogs !
Excessive force is not allowed, can’t imagine someone shooting a Shitzu; the man is a Moran. Protect you dogs, rural laws may well be different, check with your city. Cities usually require dogs to be on leash at all times. However, one cannot just shoot them if they are not or merely because they go onto someone else’s property, unless it is to protect oneself form being bitten or to protect your chattel, chickens, for example.
